1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website https://obdthink.com (the "Site") and the OBDThink mobile application for iOS and Android (the "App"), together referred to as the "Service".

By accessing the Site, downloading the App, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Service Description

OBDThink ("we", "us", "our") is an independent aftermarket provider of automotive diagnostic and coding software, focused primarily on BMW and MINI vehicles, and other compatible makes where supported. The App communicates with your vehicle through a compatible OBD-II adapter to read diagnostic data, clear fault codes, display live parameters, and apply certain coding changes.

We are not affiliated with, endorsed by, or sponsored by BMW AG, MINI, Mercedes-Benz, the Volkswagen Group, or any vehicle manufacturer. All manufacturer names, model designations, and trademarks are the property of their respective owners and are used for identification and compatibility purposes only.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the App. By using the Service you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

You should only perform coding and diagnostic operations on a vehicle that you own or for which you have explicit authorization from the owner.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use (or internal business use where applicable).

Important — read carefully. Coding and programming modify the electronic control units (ECUs) of your vehicle. These are advanced operations that carry inherent risks. Proceed only if you understand and accept these risks.

6. Manufacturer Warranty

Aftermarket coding and modifications may void or limit your vehicle's manufacturer warranty, or may be detectable by dealers and service centers. We do not guarantee that any change is undetectable, reversible, or compliant with manufacturer policies.

It is your responsibility to understand the warranty, leasing, or service-contract implications of any modification before you proceed. We are not responsible for any loss of warranty, dealer disputes, or related costs.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or compatible with every vehicle, model year, configuration, or adapter. Diagnostic readings, compatibility indicators, and coding outcomes are provided for informational purposes and may not be complete or accurate for your specific vehicle.

9. Limitation of Liability

To the maximum extent permitted by applicable law, OBDThink and its operators, contributors, and suppliers shall not be liable for any:

To the extent that liability cannot be excluded, our total aggregate liability to you shall not exceed the amount you paid (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as liability for death or personal injury caused by negligence, or fraud).

10. Adapters & Third-Party Hardware

The App requires a compatible OBD-II adapter to function. Adapters are manufactured and sold by third parties. We do not manufacture adapters and are not responsible for their quality, performance, safety, or availability. Recommendations on our Site (including the Adapters page) are provided for guidance only and do not constitute a warranty.

Compatibility can vary by adapter chipset, firmware, vehicle model, and model year. We do not guarantee that any particular adapter will work with your vehicle or with all features of the App.

11. Payments & Purchases

The App is free to download. Certain features, coding functions, or content may require a one-time purchase or paid unlock ("In-App Purchases"). All purchases are processed by the Apple App Store or Google Play Store and are subject to their respective terms, billing, and refund policies.

12. Intellectual Property

All content on the Site and within the App — including software, text, graphics, logos, the OBDThink name and brand, blog articles, illustrations, and the overall design — is owned by us or our licensors and is protected by intellectual property laws. You may not use our trademarks or content without our prior written permission.

Third-party trademarks (such as vehicle manufacturer names and logos) remain the property of their respective owners and are referenced solely for identification and compatibility.

The Service relies on third-party platforms and services, including the Apple App Store, Google Play, analytics providers, and hosting infrastructure. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services, and links to external sites do not imply endorsement.

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we use it. By using the Service, you consent to the data practices described there.

15. Termination & Changes

We may suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or use the Service in a manner that could cause harm or legal liability. Upon termination, the license granted to you ends and you must stop using the Service.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law & Contact

These Terms are governed by and construed in accordance with the laws applicable to the operator of OBDThink, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the competent courts at the operator's principal place of business, except where mandatory consumer-protection laws of your country of residence provide otherwise.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
